iamnativ.com (the “Platform”) is operated by Aymak Creative Services Ltd., a company dedicated to showcasing and connecting African creative talent with global clients. By accessing or using our services, you (the “User”) confirm that you have read, understood, and agree to be bound by these Terms and Conditions (the “Terms”), alongside the Privacy Policy and any other policies provided by iamnativ. If you do not agree, please stop using the Platform immediately.

 

1. Definitions and Key Terms

For the purposes of this agreement, the following terms will have the meanings assigned to them:

1.1 Creative: A registered individual or entity providing services or products, including but not limited to photography, videography, sound design, voiceover work, graphic design, translation, scriptwriting, animation, editing, and other creative outputs.

1.2 Client: Any individual, organization, or legal entity that hires or engages a Creative through the Platform for services or content creation.

1.3 Work Product: All deliverables submitted by Creatives to Clients, including drafts, completed works, revisions, and related materials.

1.4 Service Fee: A percentage deducted by iamnativ from payments made to Creatives for services rendered.

1.5 Dispute: Any disagreement or conflict arising between Users, whether related to payments, deliverables, or the Platform’s use.

1.6 Subscription Plans: Tiered access options offered to Creatives, each with its own features and fee structure.

1.7 Platform Wallet: A digital wallet integrated into iamnativ for managing credits, withdrawals, and payments.

 

2. Eligibility and Registration

2.1 Minimum Age Requirement: You must be at least 18 years of age to register as a Creative.

2.2 Account Registration Process:

      ⦁ To create an account, you must provide accurate and verifiable information, including your legal name, a valid email address, portfolio samples, and professional details.

      ⦁ You are responsible for maintaining the accuracy of this information. Updates must be made promptly via your account dashboard.

2.3 Verification: All Creatives are required to verify their identity. This may include submitting:

      ⦁ A government-issued ID or passport.

      ⦁ Proof of address, such as utility bills or bank statements.

      ⦁ A live photograph for matching purposes.

2.4 Rejection or Termination of Accounts:

iamnativ reserves the right to reject any application for registration or terminate an account if:

      ⦁ The provided information is false, incomplete, or misleading.

      ⦁ The User has violated the Terms or engaged in prohibited activities.

2.5 Business Registration (Optional): Businesses providing creative services may also register under a business account.

 

3. Subscription Plans and Payment Terms

3.1 Available Subscription Plans:

iamnativ offers two main subscription tiers:

A. Annual Plan ($49/year)

Includes:

      ⦁ Access to unlimited job postings and proposals.

      ⦁ Enhanced portfolio visibility and promotional tools.

      ⦁ Invitations to exclusive events, competitions, and meetups.

      ⦁ Access to advanced Creative Labs for skill-building and networking.

B. Free Starter Plan ($0/month)

Includes:

      ⦁ Limited access to job opportunities and basic promotional tools.

      ⦁ Restricted entry to Creative Labs and webinars.

3.2 Payment and Renewal:

      ⦁ Subscriptions renew automatically unless canceled at least seven days prior to the renewal date.

      ⦁ Payments are processed securely through the Platform’s payment partners.

3.3 Refund Policy: Subscriptions are non-refundable. This includes instances of account suspension due to violations of these Terms.

 

4. Account Responsibilities

4.1 Confidentiality: Users are responsible for maintaining the confidentiality of their login credentials and ensuring their account is not accessed by unauthorized individuals.

4.2 Prohibited Actions:

      ⦁ Sharing login credentials with third parties.

      ⦁ Creating multiple accounts without explicit approval from iamnativ.

      ⦁ Misrepresenting skills, qualifications, or identity.

4.3 Notification of Breaches: Any unauthorized access or breach must be reported to iamnativ immediately via the support team.

4.4 Account Suspension and Restoration: Accounts suspended due to violations can be restored only after a thorough review and compliance with remedial steps prescribed by iamnativ.

 

5. Platform Workflow for Creatives

5.1 Job Application:

      ⦁ Creatives may browse and apply for job opportunities listed by Clients.

      ⦁ Applications should include a professional proposal outlining the Creative’s rates, timeline, and approach to the project.

5.2 Client Selection:

Clients select a Creative based on profiles, proposals, and reviews. Selection does not guarantee job confirmation until formal agreement via the Platform is completed.

5.3 Execution and Delivery:

      ⦁ Creatives must adhere to deadlines and deliverables as agreed upon with Clients.

      ⦁ Revisions must be reasonable and within the scope of the original agreement unless renegotiated.

5.4 Platform Protection:

      ⦁ All communication and file exchanges must occur within the Platform to ensure transparency and accountability.

      ⦁ Circumventing the Platform for off-site transactions is strictly prohibited.

5.5 Payments:

      ⦁ Payments are released to Creatives upon client approval of deliverables.

      ⦁ Funds are subject to the Platform’s service fees and withdrawal timelines.

 

6. Service Fees and Payment Policies

6.1 Service Fee: A flat 39% service fee is applied to all payments made to Creatives.

6.2 Withdrawal Methods:

      ⦁ Creatives may withdraw funds via bank transfer, PayPal, or mobile money.

      ⦁ Withdrawals are processed within 7-10 business days, subject to verification.

6.3 Currency Conversion:

All transactions are processed in USD. Conversion fees may apply for payments in other currencies.

6.4 Payment Disputes:

Disputes must be filed within seven calendar days. Failure to report issues within this timeframe may result in forfeited claims.

 

7. Intellectual Property and Usage Rights

7.1 Ownership of Work Product:

Creatives retain intellectual property rights unless explicitly transferred to the Client in writing.

7.2 Platform License: By uploading content, Creatives grant iamnativ a non-exclusive, royalty-free license to use such content for promotional purposes.

7.3 Client Usage Rights:

Clients receive a non-exclusive license to use the Work Product for agreed purposes unless otherwise negotiated.

7.4 Prohibited Use: Users may not:

      ⦁ Upload plagiarized, copyrighted, or unauthorized materials.

      ⦁ Use content obtained through iamnativ for unlawful or unethical purposes.

 

8. Community and Professional Standards

8.1 Respectful Communication: All communication between Creatives and Clients must remain professional, respectful, and free of discriminatory language.

8.2 Deliverable Standards:

      ⦁ Creatives must deliver high-quality work aligned with their proposal.

      ⦁ Late or substandard work may result in penalties, including account suspension.

8.3 Review and Feedback:

Reviews must be honest and relevant. Manipulating reviews to inflate ratings is prohibited.

 

9. Dispute Resolution

9.1 Internal Resolution:

      ⦁ Users must attempt to resolve disputes directly via the Platform’s messaging system.

9.2 Mediation: If a resolution is not reached, disputes can be escalated to iamnativ’s mediation team.

9.3 Binding Decision: iamnativ reserves the right to issue a final, binding decision on disputes.

 

10. Suspension and Termination

10.1 Grounds for Suspension: Accounts may be suspended for:

      ⦁ Violations of the Terms.

      ⦁ Repeated delivery of poor-quality work.

      ⦁ Fraudulent or illegal activities.

10.2 Effects of Suspension: Suspended accounts forfeit pending payments and access to the Platform.

10.3 Appeal Process: Suspended users may appeal decisions by providing evidence supporting their case.

 

11. Governing Law and Jurisdiction

These Terms are governed by the laws of Uganda and the Netherlands, depending on operational jurisdiction.
